Amended Draft Construction Regulations
The long anticipated “Amended Draft Construction Regulations” were published for public comment on 11 May 2010.
The Minister of Labour, on the recommendation of the Advisory Council of Occupational Health and Safety under section 43 of the Occupational Health and Safety Act, 1993 (Act 85 of 1993), published the draft amendments to the Construction Regulations for general information and comment. Comments or representation with regards to this amendments may be lodged in writing to the Director General, Department of Labour, within 60 days from the date of publication e.g. up and until 11 July 2010. Although these draft regulations are more self regulating and will introduce safer practices, there are one or two issues that need refining. The definition of Construction Work read in conjunction with the Scope of Application for example, would imply that the smallest of construction work e.g. painting a Granny Flat, will be deemed as construction work in terms of the regulations and the Granny will then, have to provide the Contractor with a specification for the work and apply for a construction permit.
