CIDB Register of Projects Implemented
In terms of sections 5(2)(f) and 22(1) of the Construction Industry Development Act of 2000, the Construction Industry Development Board (CIDB) has established a Register of Projects for the purpose of gathering information on the nature, value and distribution of infrastructure projects.
Section 22(3) of the Act requires National and Provincial Departments, Municipalities and Public Entities delivering infrastructure to register all construction awarded above the prescribed tender value to be registered on the Register of Projects. The CIDB Board in accordance with Notice 75 of 2011 published in Government Gazette No. 34214 of 21 April 2011, instruction to National and Provincial Departments , Municipalities and Public Entities delivering infrastructure to register all construction contracts awarded through a tender process during 2009/2010 and 2010/2011 financial years as applicable in Regulation 18(1A)(a) and (b).
To enforce the legislative requirement to register tender advertisements on the Tender System and register projects awards, progress and completion and/ or cancellation on the Register of Projects, the CIDB Board will from 1 May 2011 conduct random Compliance Audits of projects registered by public sector clients. Failure to comply with the instruction may result in the following:
1) Name and Shame list of non- compliant clients 2) Imposition of a fine or penalty to the maximum of R100 000 3) Referral to the Special Investigations Unit for further investigation and prosecution.
The CIDB Board Notice was issued in the name of Mr Ronnie Khosa, the Chief Executive Officer of the CIDB, in his capacity as the accounting authority in terms of the Public Finance Management Act of 1999.
