
The draft Regulations to Conduct Investigations have been published for comment.
In terms of section 5(1)(d) of the Skills Development Act 97 of 1998, one of the functions of the NSA is to conduct investigations on any matters arising out of the application of the SDA.
The NSA has however not had regulations supporting these powers. In the absence of such regulations, when Minister deemed it necessary to investigate SETAs, they challenged and slowed down the pace of investigations commissioned by the NSA on instruction of the Minister.
It is against this background that the NSA saw the need to develop Investigation Regulations for the purposes of strengthening the role its oversight role.
The Regulations will provide for the establishment of an Investigative Task Team, thus ensuring separation of powers within the Authority. They will regulate the manner in which the NSA conduct its investigations and create a standardised approach for all NSA investigations arising from the application of the SDA.
