The MBSA domestic subcontract agreement

Earlier this year Master Builders South Africa issued the MBSA Domestic Subcontract Agreement for use with the JBCC Principal Building Agreement 6.2. The Association realises that this document was released during the national lockdown and members may have forgotten that this document is available from our Print Studio.

The advantages of using this document over any other domestic subcontract agreement is the following:

  • Aligned to the JBCC PBA 6.2
  • Each party knows what the terms and conditions of the contract are
  • Responsibilities of each party
  • Documentation required before commencement
  • Commencement & completion dates
  • Date of progress claim submission and payment
  • Scope of the contract
  • Process for contract instructions for changes to the items or quantities agreed upon at signature of the agreement
  • Process of settlement of disputes
  • All clauses aligned to the same clauses in the Principal Building Agreement

It is important that all documentation is in place before commencement of the project as this will alleviate any misunderstandings at a later date. In these extremely challenging economic times, it is important for the survival of any business that disputes and interruptions to the projects due to miscommunication are avoided.
