On 9 November 2018, the Government Gazette published the Standard for Minimum Requirements for Engaging Contractors and Sub-Contractors on Construction Works Contracts.
This Standard was Gazetted due to a marked increase in disputes in the Construction Industry in the past few years. The majority of these disputes are a result of a lack of utilization of correct contracts between the contracting parties.
Minimum Requirements
- Letter of Good Standing from Department of Labour or FEM
- Proof of registration with Bargaining Council (not applicable in KwaZulu-Natal) A written contract must exist using the latest edition of a recognised contract
- The date of payment must be clearly defined and may not be later than 30 days from the subcontractor’s statement of payment
The employer shall, upon request of a subcontractor, provide proof of payment to the main contractor in the event of a dispute of non-payment
