Voetstoots Clause and Consumer Protection Act

Throughout May and June 2018, Attorneys Maynard Menon Govender Singh Incorporated gave an excellent presentation on the Voetstoots Clause in contracts, at the 
Association’s Durban and Pietermaritzburg offices. 

In their conclusion, they stated that most suppliers of building materials supply such materials in the ordinary course of business, therefore the buyer is protected by the Consumer Protection Act (CPA) which takes precedence over a voetstoots clause in any agreement of sale. All building materials must be sold with the expectation that they are of good quality, in good working order and free of any defect.
