| Dear Members and Readers It was indeed pleasing to note that despite a second bout of inclement weather during the month of May, the Durban Golf Day which was postponed to 3 June 2022 was a spectacular event with perfect weather conditions. The event saw over 100 keen golfers taking to the fairways at the pristine Mount Edgecombe County Club. The prestigious Dulux Cup was won by the team from Builders, whilst Hilti SA won the Best branded Tee- Box. This was preceded by the South Coast Golf Day earlier in May this year at the San Lameer Golf Estate and congratulations go out to the winner FS Gonzalves Construction. The Association extends its sincere gratitude to all marketing partners, members and participants for their role in the two successful Golf Days hosted by the Association. The Annual General Meeting of the Association will be held on 28 June 2022 in a hybrid format which provides for attendance in person at the Association Head office in Westville or via the MS Teams Platform. Members are reminded to secure their attendance as per the notice circulated on 2 June 2022. The 2022 Master Builders Congress will be held at The Capital Zimbali in the KZN North Coast on 9 September 2022. Members have received the Save the Date notice and are encouraged to attend the Congress, which will feature Government leaders, industry experts, thought leaders and trending industry topics. The theme of the Congress is Reconstructing South Africa. The National Safety Awards will be held at the Gala dinner after the Conference. The Constitutional Court clarified the issue around the 2017 Preferential Procurement Regulations on 30 May 2022 and confirmed that the 2017 Regulations were still valid. During the period of uncertainty, exemptions from the Regulations were granted to government entities to deal with quotations and advertisements. Following clarity on the judgment, the 2017 Regulations must be complied with and will remain in place until early 2023, unless new Regulations are in place prior thereto.Members will recall that draft Preferential Procurement Regulations were published for comment earlier this year. Click here for Treasury Media Statement. The Member meeting held in May 2022 saw the National Home Builders Registration Council (NHBRC) address the issues of contractor and project registration. Members took the opportunity to engage with the NHBRC during this session. The Association also arranged a member workshop on the Protection of Personal Information Act (POPIA) where attendees received CPD points. The workshop focussed on the importance of compliance, securing personal information and the activities required to ensure compliance with the POPI Act. The June edition covers the obligations of a home builder as set out in the Housing Consumers Protection Measures Act.A must-read is the article on the Defects Liability Period, which is the fourth article in a series of articles on managing a construction contract.
